1. Acceptance of Terms

By accessing or using spikebins.ca and any services or products offered by SPIKE BINS ("we", "us", "our"), you ("you", "the Customer") agree to be bound by these Terms & Conditions. If you do not agree, do not use the site or the services.

2. Services Covered

These Terms cover (a) roll-off bin and walking-floor disposal services in Hamilton, the GTA, Halton, Peel, York, Durham, and Mono, Ontario; and (b) the sale of workwear, headwear, jobsite gear, and related SPIKE BINS branded merchandise.

3. Bin Rental Terms

Bin rentals are quoted per load and per day. The Customer is responsible for ensuring the loaded bin complies with O.Reg 347 (Ontario General Waste Regulation) and any applicable RPRA, CIRCIL Levy, or municipal requirements. Loads containing prohibited materials (hazardous waste, treated wood, CCA-treated lumber, electronics, tires, or other regulated streams) may be rejected, returned, or assessed at the mixed-waste rate. The Customer indemnifies SPIKE BINS against fines or penalties resulting from misrepresentation of load contents.

4. Merchandise Sales

All workwear and merchandise sales are final unless otherwise stated. Sizes are provided as a guide; Customer is responsible for confirming fit prior to purchase. Custom or personalized items are non-returnable. Defective items may be exchanged within 14 days of delivery subject to inspection.

5. Pricing & Payment

Prices displayed on spikebins.ca include applicable HST unless otherwise indicated. SPIKE BINS reserves the right to update pricing, surcharges (including fuel, CIRCIL Levy, and cross-border tariff adjustments), and service availability at any time without prior notice. Bin rental invoices are due Net 30 unless other terms are agreed in writing.

6. Limitation of Liability

To the maximum extent permitted by law, SPIKE BINS is not liable for indirect, incidental, consequential, or punitive damages arising from the use of our website, services, or products. Aggregate liability for any claim is limited to the amount paid by the Customer to SPIKE BINS in the twelve (12) months preceding the event giving rise to the claim.

7. Privacy

Personal information collected through spikebins.ca is handled in accordance with our Privacy Policy and applicable Canadian privacy legislation (PIPEDA).

8. Changes to These Terms

SPIKE BINS may revise these Terms at any time by posting an updated version on this page. Continued use of the site or services after changes are posted constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be resolved in the courts of Ontario.
